Assault is generally considered a first-degree misdemeanor. If convicted you could face:

  • Maximum of 180 days in jail

  • Maximum 5 years of probation

Negligent Assault Penalties

Negligent assault is generally considered a third-degree misdemeanor. If convicted you could face:

  • Maximum of 60 days in jail
  • Maximum fine of $500
  • Maximum 5 years of probation

Felonious Assault Penalties

Felonious assault is generally considered a second-degree felony. If convicted you could face:

  • Maximum of 8 years in prison
  • Maximum fine of $15,000
  • Maximum 5 years of probation

Assault Cases We Have Gotten Dismissed

Take a look at just a few of the assault cases we have gotten dismissed:

  • Client’s Felonious Assault Charges Dismissed: Attorney Bailey was able to use video footage of an incident to prove that the alleged victim of an assault case was picking fights with numerous people and instigating attacks.
  • Client’s Assault Charges Dismissed: Attorney Bailey was able to use a polygraph examination and video footage from the officers’ body cameras to dismiss his client’s charges of assault, criminal damaging, and persistent disorderly conduct while intoxicated.
  • Ex-Michigan Defensive End’s Charges Dismissed: Attorney Ken Bailey represented Frank Clark who was facing charges of Assault and Domestic Violence. The assault charges were dismissed, and the domestic violence charges were reduced.
