    Jury Says "Not Guilty" Despite Seeing Video Evidence Attorney Ken Bailey's client was acquitted on all counts -- Felonious Assault and Assault -- after taking the stand and talking about the incident. Members of the jury indicated they did not feel the Government showed all the required elements to warrant a conviction. Bailey's only statement to the press was that "Juries decide cases based upon facts, and I have never worked with more respectable counsel than Assistant Prosecutor Aaron Lindsey." Attorney Ken Bailey is the President-Elect of the Ohio Association of Criminal Defense Lawyers.

    Bailey Wins Appeal Allowing Suppression of Breath Tests in Ovis

    Attorney Kenneth R. Bailey of the Bailey Legal Group won in the Sixth District Court of Appeals.

    The government appealed Judge Lux's suppression of a breath test in an OVI case alleging the calibration failures were too attenuated from the subject's breath test. Judge Lux ruled he simply had no faith in the breath test result, and the Sixth District Court of Appeals agreed.

    Many of these machines are twenty years old or older, and they should be challenged.

    Not Guilty Verdict for Nurse's Aide of Felony Patient Abuse

    Criminal Defense attorney Kenneth R. Bailey obtained a Not Guilty verdict for a Navy Veteran accused of patient abuse at the Ohio Veterans Home.

    The STNA was accused of repeatedly forearming a patient on the chest; however, no bruising or other signs of abuse were evident.

    An Erie County jury, which included a Registered Nurse (Assistant Director of Nursing) and a paralegal, found out client Not Guilty after a three-day trial.

    One juror stated, "We acquitted an innocent man today, who was being railroaded by the state and your presenting of the facts made our decision unanimous, they were precise and TRUE. Thank you for your dedication to the LAW. We are all in Erie county blessed to have you defend us."

    Criminal defense attorney K. Ronald Bailey obtained a dismissal with prejudice of a seven (7) count felony indictment for Illegal Processing of Drug Documents.

    The doctor is famous for being the first in the area to treat AIDS patients, as well as, still performing frequent house calls for patients in need.

    Wrongfully Convicted Released after 14 Years in Prison K. Ronald Bailey obtained the release of a man who was wrongfully convicted and sent to prison. The Government continues to attempt to return this client to prison, in spite of the overwhelming evidence of his innocence, evidence of lies in his original trial, and multiple abuses of the process. Mr. Bailey continues to fight for vindication and release.

    Attorney Kenneth R. Bailey represented a local professional accused of Driving Under the Influence of Alcohol.

    An Ohio State Highway Patrolman obtained a breath sample, and he alleged the professional was operating a motor vehicle while under the influence of alcohol. The officer alleged the professional refused to provide a breath sample.

    Attorney Ken Bailey investigated and discovered multiple problems with the machine, bolstering his argument and achieving a dismissal of the professional's charge of DUI.

    Attorney Ken Bailey obtained permanent custody for the father of a three (3) year old boy, after having obtained emergency custody.

    The Court found there had been a change in circumstances, which made it in the child’s best interest for custody to be changed.

The County Prosecutor's office properly fulfilled their duty in recognizing the problems with their case and moved for an honest resolution of dismissal.

Bailey obtained dismissal of a felony theft case where his client was accused of taking checks from his employer and cashing them for more than Twenty Thousand Dollars ($20,000.00). Bailey used bank security cameras, phone records, and interviews to negotiate for his client's freedom.

    The government alleged Mr. Bailey's client was a fourth time offender arrested with bloodied knuckles, meaning the client faced sixty (60) months in prison.

    Mr. Bailey was able to disprove the government's allegations and produce enough exculpatory evidence that the prosecution had no option but to dismiss the charges.

    Attorney K. Ronald Bailey and co-counsel Jon Paul Rion represented client indicted with a second degree felony of complicity to possession of marijuana and complicity to prepare marijuana for sale.

    Mr. Bailey's client received only community control sentencing.

    Family Law Attorney Ken Bailey obtained custody for the father of five (5) children. The Court terminated the parties prior agreement for shared parenting, awarded the father custody and support.

    Family Law Attorney Ken Bailey obtained permanent custody for two children and an award of child support to the sister of two (2) girls over the opposition of the children's father.

Mr. Clark's assault charges were dismissed, and Mr. Clark's domestic violence charges were reduced to persistent disorderly conduct with a sentence of time served and a cash fine. Mr. Bailey credits Mr. Clark's counseling efforts, honesty at the Sandusky Municipal Court, and appreciation for the seriousness of the allegations made against him.
